4. Educational Information and Resources

The information published on this website is provided primarily for educational and informational purposes.

Yamas makes reasonable efforts to ensure that its educational information and resources are accurate, relevant and useful. However, educational recommendations, programme descriptions, schedules and other website content may be updated or changed from time to time.

Information provided on the website should not automatically be interpreted as a substitute for an individual learner assessment, school-specific advice or a professionally designed educational intervention.

5. Intellectual Property

Unless otherwise stated, the content and materials appearing on this website are owned by or licensed to Yamas Educational Consult. This includes, but is not limited to:

  • Yamas ReadSpella materials;
  • programme names and descriptions;
  • books and reading resources;
  • educational activities;
  • worksheets;
  • lesson and training materials;
  • assessment materials;
  • text;
  • graphics and illustrations;
  • photographs and videos;
  • logos and branding;

6. Permitted Educational Use

Where Yamas expressly provides a resource for educational use, the purchaser or authorised user may use that resource for the purpose and within the scope specified by Yamas.

Unless expressly authorised in writing, purchasing or receiving a Yamas resource does not transfer ownership of the underlying copyright or intellectual property to the purchaser.

Schools, teachers and other authorised users must not reproduce Yamas materials in quantities or for purposes beyond the permission granted with the relevant product or service.

7. Books and Educational Products

Where books, educational tools or other physical products are offered for sale through the website, product descriptions, images and specifications are provided to assist customers in making informed purchasing decisions.

Yamas makes reasonable efforts to ensure that product information is accurate. However, minor variations in colour, appearance, packaging or presentation may occur.

Product availability is subject to stock. Yamas reserves the right to discontinue a product, modify its specifications or change its price before an order is accepted.

8. Training Programmes and Consultancy Services

Yamas may advertise and provide different forms of professional development and consultancy, including full training programmes, refresher training, school-based training, cluster-based training and other educational services.

An advertisement, announcement or promotional communication does not necessarily constitute a confirmed booking. A training programme or consultancy engagement becomes confirmed when Yamas has accepted the booking or subscription in accordance with the applicable programme terms.

Specific training dates, fees, locations, duration, participant requirements, deliverables and other conditions may be stated separately in a quotation, invoice, proposal, booking confirmation or other written agreement. Where applicable, those specific terms will form part of the agreement between Yamas and the client.

9. Fees and Payments

Prices and fees displayed on the website are subject to change unless a specific price has been confirmed in writing.

Where applicable, the total amount payable by a customer will be communicated before a transaction is completed. Payment methods may include those made available by Yamas from time to time.

A booking, order or subscription may not be considered confirmed until the required payment or agreed payment arrangement has been received or accepted by Yamas.

10. Orders and Acceptance

Submitting an order or enquiry through the website does not necessarily mean that Yamas has accepted the order. Yamas may decline or cancel an order where:

  • the product is unavailable;
  • there is an obvious pricing or description error;
  • payment cannot be verified;
  • the requested service is unavailable;
  • the transaction appears fraudulent or unauthorised; or
  • another legitimate circumstance prevents fulfilment.

Where payment has already been received for an order that Yamas cancels, the applicable refund arrangements will apply.

11. Delivery of Products

Where physical products are purchased, applicable delivery arrangements, estimated delivery times and delivery charges will be communicated to the customer.

Delivery times may vary depending on location, stock availability, courier arrangements and circumstances beyond Yamas's reasonable control. Any stated delivery period is an estimate unless expressly confirmed otherwise.

Yamas is not responsible for delays caused by third-party delivery providers or circumstances beyond our reasonable control.

12. Returns, Exchanges and Refunds

Returns, exchanges and refunds for products and services will be governed by the applicable Returns, Exchanges and Refund Policy published by Yamas.

Where a separate policy applies, that policy forms part of these Terms. Customers should review the applicable policy before completing a purchase or booking.

Nothing in these Terms is intended to remove or restrict any rights that a customer may have under applicable Ghanaian law.

13. Training Cancellation and Rescheduling

Specific cancellation, postponement, rescheduling and refund arrangements for training programmes may vary according to the programme or booking.

Where special terms apply, they will be communicated to the participating school, organisation or individual before or at the time of booking.

Yamas may reschedule a programme where circumstances reasonably require it. Where Yamas cancels a paid programme and cannot provide an acceptable alternative arrangement, the applicable refund terms will apply.

14. Third-Party Services and Links

The website may contain links to third-party websites, platforms or services. These third parties operate independently of Yamas and may have their own terms of use and privacy policies.

Yamas is not responsible for the content, availability, security, privacy practices or operations of third-party websites or services. Users access third-party websites at their own discretion and risk.

15. Website Availability

Yamas aims to keep the website available and functioning properly but does not guarantee that it will always be available, uninterrupted, secure or error-free.

The website may occasionally be unavailable because of maintenance, technical problems, hosting or network failures, cybersecurity incidents, updates or circumstances beyond our reasonable control.

16. Accuracy of Website Content

Yamas makes reasonable efforts to ensure that information published on the website is accurate and current.

However, errors, omissions or outdated information may occasionally occur. Yamas reserves the right to correct errors and update website information, including product descriptions, programme details, prices and availability.

If you submit information through the website, including enquiries, feedback, registration information or other content, you agree that:

  • the information you provide is accurate to the best of your knowledge;
  • you have the right and authority to provide the information; and
  • the information does not unlawfully infringe the rights of another person.

You must not submit information that is unlawful, misleading, defamatory, abusive, threatening or otherwise inappropriate. The collection and handling of personal information submitted through the website are governed by the Privacy Policy.

18. Learner and Children's Information

Yamas provides educational services and resources that may involve schools, teachers, parents, guardians and learners.

The website should not be used by children to submit personal information without appropriate adult, parental, guardian or institutional involvement where required. Schools, parents, guardians and other authorised persons are responsible for ensuring that any learner information submitted to Yamas is provided lawfully and with the necessary authority.

Yamas will handle personal information in accordance with its Privacy Policy and applicable data-protection requirements.

19. Privacy

Your use of the website may involve the collection and processing of personal information. Yamas's collection, use, storage, disclosure and protection of personal information are explained in our Privacy Policy.

  • your misuse of Yamas products or materials; or
  • your infringement of the rights of Yamas or another person.

22. Suspension or Termination

Yamas may suspend or terminate access to the website or particular services where reasonably necessary to protect the website, its users, its intellectual property or its legitimate business interests, or where a user has violated these Terms.

Termination will not affect rights or obligations that arose before termination.

23. Changes to These Terms

Yamas may update these Terms from time to time to reflect changes in its services, website operations, legal requirements or business practices. The updated version will be published on the website with a revised Last Updated date.

Where appropriate, significant changes may be communicated through the website or other available communication channels. Continued use of the website after updated Terms have been published constitutes acceptance of the revised Terms, to the extent permitted by law.

24. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Ghana.

Any dispute arising from the use of the website, products or services should, where reasonably possible, first be addressed through good-faith communication between the parties.
